WAKF FOR MASJIDS

AYATOLLAH ABUL QASIM AL KHOI

2700. A carpet which has been endowed in Husayniya (religious place) cannot be taken to a masjid for offering prayers, even though the masjid may be near the Husayniyah.

2701. If a property is endowed for the repairs of a masjid and that masjid does not stand in need of repairs, and it is also not expected that it will need repairs for quite some time, the income from that property can be spent on a masjid which stands in need of repairs

2700. A carpet which has been waqfed in Husayniya (Imambargah) cannot be used in mosque for offering prayers, even if the mosque may be near the Husayniyah.

2701. * If a property is waqfed for the maintenance of a mosque, and that mosque does not stand in need of repairs, and it is also not expected that it will need repairs for quite some time, and if it is not possible to collect and deposit the accrual till such time when it could be used for the repairs, then, as an obligatory precaution, the income should be used for the purposes which has nearest conformity with the intention of the one who waqfed it, like spending it in other needs of the same mosque, or for the repairs of any other mosque.

2699. A carpet which has been waqfed in Husayniya (Imambargah) cannot be used in mosque for offering prayers, even if the mosque may be near the Husayniyah.

2700. * If a property is waqfed for the maintenance of a mosque, and that mosque does not stand in need of repairs, and it is also not expected that it will need repairs for quite some time, the income of it can be used for repairs for another mosque which needs repairs.

2701. If a property is waqfed whose income is for repairs or maintenance of mosque, for the leader of prayers and the reciter of Azan and if it is known or certain that one who has waqfed has kept for everybody a section in the income then it should be expended in such a manner. And if it is not certain or satisfied then initially it should be used for repairs of the mosque then if some income is left then it should be given equally to the leader of prayers and the reciter of Azan

2687. A carpet which has been waqfed in Husayniya (Imambargah) cannot be used in mosque for offering prayers, even if the mosque may be near the Husayniyah.

2679. If a property is waqfed whose income is for repairs or maintenance of mosque, for the leader of prayers and the reciter of Azan and if it is known or certain that one who has waqfed has kept for everybody a section in the income then it should be expended in such a manner. And if it is not certain or satisfied then initially it should be used for repairs of the mosque then if some income is left then it should be given equally to the leader of prayers and the reciter of Azan and it is better if they distribute it themselves.

 TRADITION OF THE INFALLIBLES AS

1.       Abbas bin Amir narrated this by Abi Saheri who narrates this to Imam Jaffer Sadiq AS that  “I have asked Imam AS that one person has purchased a house and in its open section he has built a barn, now can he wakf this to a mosque? Imam AS replied Zoroastrians used to wakf for the fire temple”.

2.       It is narrated by Jaffer bin Ali, he by his father and he by his grand father Hasan bin Ali Koofi and he by Abbas bin Aamer and he by Abi Zahak and he narrates this to Imam Abu Abdullah Jaffer Sadiq AS that he has asked a question to the Imam “A person has purchase a house and repaired it and it was left for some time. Then he has converted it into a barn. Now can he wakf this for a mosque? Imam AS replied Zoroastrians used to wakf for the fire temple”.

3.       Imam Jaffer Sadiq AS said it has been said by his father that from my wealth wakf an amount for mourning such that the mourners come to our door for rendering condolences and lamentations and do the arrangement for it.

Note:- 

1.       In the light of the above Hadiths it is known that doing wakf for mosques is the act like Zoroastrians.

Allah will not accept his acts if it is against the intention of the person who does the wakf.. It is the time to think for the usulis that if one carpet of Husainiyah cannot be taken to the mosque than how can a mosque be built on a wakf Hussainiyah.
